Zeldasages.com requires full agreement to these Terms of Service at all registrations. By reading content on the message board and news article comments you also agree to the acceptance of these terms by virtue of your use of Zelda Sages content.  In this document ‘member’ refers to an individual person who has registered an account with Zelda Sages.  ‘Visitor’ refers to any individual who visits Zelda Sages, either on purpose or by accident.  ‘Content’ refers to material posted on Zelda Sages either by an individual member, whether it be official Zelda Sages material posted by a member of staff or a member by virtue of the definition given above.  Terms of Service may be shortened in this agreement bearing the title ‘TOS’.



Registration

In order to be eligible to register for zeldasages.com you must be of at least the age of 13 years old. If you are found to be under the age of 13 your account will be banned for one week, then deleted. We do not have the resources to comply with the COPPA procedures for allowing under 13 registration at this time and as such must deny under 13 registration until further notice. If you have falsely claimed to be under the age of thirteen you may contact us within the one week period from the date the account was banned to correct the issue. You must submit a scanned copy of a government issued ID such as your drivers license, school record, or a school ID with your birth date somewhere on the ID. If these resources are not available and you are under the age of 18, a scanned letter from your parent or legal guardian will also be accepted.



Multiple Accounts
Members are allowed only one, and no more than one, membership account on Zeldasages.com. Membership accounts can be used to access many member only content and features on Zelda Sages, and when logged into the forums, post in discussions. Having more then one account is considered a violation of the TOS.  If a member is found to have multiple membership accounts, the primary (first registered) account will be temporarily banned and the subsequent accounts DELETED.

Removal/Deletion of Membership Account

Membership accounts that are not in violation of COPPA, not activated after seven (7) days of INITIAL REGISTRATION, or not an additional account as described in Multiple Accounts above, will not be permanently removed if the membership account in question has posted public content.  Instead, accounts can be closed.  Closure of a membership account does not break the covenant entered to follow the procedures in this TOS and can not be used to evade legal action or other action on a membership account.  Closed accounts are rendered inaccessible to the member in question and will be marked as, ‘Account Closed’.  Closed accounts can, at the request of the member, have profile information hidden from all non-staff or moderator level members.  Closed accounts can be re-opened at the request of the member, provided that the Zeldasages.com administrators can feasibly identify the requester as the member in question.  Requests for account closure can be directed to a site administrator directly.

EXCEPTION: If you live in a country or territory which requires the complete removal of your account on request, or if you need to have your account removed to comply with a legal decree and/or protect your safety, you may have your account completely removed from our database. If your account is completely removed it can NEVER be recovered.

Message Board (forum), Chatroom, and News Comment Content

You understand and agree, including visitors without an account, that all messages posted on the Zeldasages.com Forums and member contributed comments are the sole property and opinion of the author. In no way is Zeldasages.com or its staff, subsidiaries, or advertisers responsible for what members post. Although the Zeldasages.com moderation team will try to limit questionable content from appearing you agree to be prepared to view such content in the forums, comments, and any user function. Zeldasages.com also includes a moderated chatroom. This chatroom is only visible to registered members of zeldasages.com. The same rule applies to messages seen in chat. All messages received in the chatroom without a moderator present should be forwarded to the webmaster for transcript review.

Zelda Sages Material

By registering for Zelda Sages you agree not to transfer, reproduce, or otherwise market any content owned by Zelda Sages or contributing members. Doing so would be an act of plagiarism and if found will be dealt with severely. Only members of Zelda Sages have the proper authentication and authorization to download some content offered by Zelda Sages. Any member found transferring these files by any means without the express written consent of the webmaster of Zeldasages.com will lose his/her download privileges, become suspended from all community activity, or both. Members submitting fan made work may request alteration or removal of their fan work at any time.

Behavior

While a member at Zeldasages.com you will be expected to refrain from the following actions in your communication using Zelda Sages services:



-Offensive Posting
: Any post, thread or message which contains racial, sexual, insulting, or otherwise deemed unsuitable content.



-Flameing
: Sudden fights or outbursts which may involve threats.



-Trolling
: Posting messages with the intent to incite anger / fights.

-Spam / Flooding
Constant pointless posts which cause a disturbance for others or advertising where not appropriate as determined by staff.



-Pornography/ Hentia: 
Any content which contains pornographic material including, but not limited to: video, audio, images, and links which either portray or allow access to pornographic material.  If the pornographic material in question is illegal, including but not limited to: child pornography, law enforcement officials will be contacted and given your IP address, username, and email address, along with information on the material in question.  In determining illegal pornographic content, the laws of the State of New Jersey, United States of America will be used.  You agree, by virtue of registration as a member, to be prosecuted within this jurisdiction as allowable by law enforcement officials should you violate this provision of the TOS.



-Hacking
: Any success or attempt to impersonate or hack another member or Zeldasages.com itself. This includes but is not limited to: E-mail fraud, forced access, unauthorized manipulation of Zeldasages.com content.  ALL HACKERS WILL BE PROSECUTED IN THE STATE OF NEW JERSEY, UNITED STATES OF AMERICA TO THE FULLEST EXTENT OF THE LAW.  BEING A NATIONAL OF A FOREIGN COUNTRY WILL NOT PROTECT YOU FROM PROSECUTION IN THE UNITED STATES.  AS PER THE INTERNATIONAL CYBERCRIME TREATY, BUDAPEST CONVENTION OF 2001 AND SUBSEQUENT ADDITIONAL PROTOCOL TO THE CONVENTION ON CYBERCRIME OF 2006, YOU CAN BE PROSECUTED IN THE COUNTRY ASSOCIATED WITH THE INDIVIDUAL YOU HACKED AND FACE HEAVY FINES AND IMPRISONMENT!



-Harassment
: Any type of harassment, stalking, etc of a member.




Violating the TOS

Violation of the Zeldasages.com TOS can result in action taken by moderators or administrators. These people have the right to lock, delete, move, and manipulate your content at any time. When you violate the rules you will accept any consequence that come your way, including but not limited to: restrictions placed on your membership account, manipulation of submitted content – including deletion, receipt of an official warning, contact of your ISP, and contact of law enforcement officials. Zeldasages.com has the right to manipulate or perform any action to your membership account and content as deemed necessary by staff to properly enforce the TOS.

Discipline Records (Warnings) and Appeal Process

Violations of the Zelda Sages TOS may, at times, result in a warning being placed in a member’s account history.  A warning is a private mark placed on a member account that can only be viewed by moderators and staff members.  Warnings can, at times, have a point value associated with them that may or may not expire over time.  Reaching twelve (12) points will result in an automatic ban from community features of Zelda Sages for the period of one month.  Reaching twenty-four (24) points can result in a permanent ban from community features.  Banned members can still access some member only content, unless these abilities are specifically revoked at the discretion of site administrators.  The site administrators have the right to restrict a member’s access to certain community functions regardless of warning point total if it is deemed to be in the best interest of the community. When a member receives a warning, a staff member will alert the member via a message that action taken due to a TOS violation has resulted in a warning being placed on their account.  Additionally, the individual issuing the warning will alert the member how many active points are on the membership account.  Members have the right to request their warning history at any time.

Warnings may be appealed by contacting a site administrator.  The site administrator will review the incident in question by evaluating the original content report (if one exists), the original content (if still in the database), and any notes left by the member of the moderation team or staff that applied the warning.  If to the satisfaction of a site administrator the warning was applied in error, or an improper warning was applied, the warning will be either altered or expunged from the account record, depending on the decision of the site administrator reviewing the appeal.  The member in question will be notified of the decision and given the reason for the decision.  If an appeal is denied, and the site administrator contact WAS NOT the webmaster, the member may contact the webmaster of Zeldasages.com to request review of the appeal.  The decision of the webmaster, whether the first or a subsequent appeal, IS FINAL.

Bans may also be appealed by contacting a site administrator.  Bans received as a result of earning twelve (12) active warning points on a membership account or a short term (non-permanent) ban may be shortened or removed if the member in question is judged by a site administrator to be sincerely sorry for the actions they committed.  Members permanently banned from the community who wish to have the ban removed from their account must contact the webmaster no earlier than two months after the date the member was permanently banned.  The webmaster will counsel with the member and determine if the member in question is mature enough to resume activity in the community.  If a member is granted a lift of a permanent ban they will enter the community on probation for a period not to exceed three months, during which time restrictions may be applied to the member’s ability to submit content.  Any violation by a member on probation will result in a permanent ban.  After the probation period, the member will be subject to the same provisions for a permanent ban (24 active warning points) as other members.  In the event a member with 24 permanent warning points is allowed to return to the community, site administrators will discuss the best way in which to give the newly re-admitted member a fair chance at successfully participating in the community.

You can’t sue us
By registering for Zeldasages.com you agree to not hold any member of the staff responsible for any action done by members or any other party. You agree not to hold Zeldasages in any way responsible for ….anything.

Other Information
You agree to abide by these rules visiting and more so registering for Zeldasages.com. Zeldasages.com and its administrators have a right at their sole discretion to change this TOS at any time without prior notification of any party.  Use of Zeldasages.com media and materials that are reserved for members only must not be directly linked to by unauthorized individuals.  By virtue of viewing Zeldasages.com and/or registering as a member, you agree to comply with any and all changes and alterations to this TOS.
